To make a claim under workers' compensation law, your injury must have happened on the job. Even if you were off work premises but on work time and you slipped and fell or you fell in your work's parking lot before entering the building, you can file a claim.
What you say to your employer, what you say to the company doctor and what you say to their insurer is important and can be used against you. These entities are not necessarily out to help you get better or provide you with workers' compensation. Many times, the complexities of workers’ compensation law are used to prevent or delay benefits to injured workers. As your lawyers, our job is to do all we can to help make sure that you get your benefits that you are entitled to under law.
Under workers' comp law, an injured or disabled worker may be entitled to:
- 100 percent medical bills paid (when treatment is by an authorized doctor) and rehabilitation
- Two-thirds of the workers' weekly wage (when taken out of work by doctor's order)
- Additional compensation for partial or permanent disability. In Alabama, an injured worker has only two years from the date of injury or from the time of a payment for temporary total disability to file a workers' compensation lawsuit. This means that if you do not do this within the two years' time limit, you are barred forever from filing a recovery claim.
To collect workers' compensation you must:
- Report the injury, generally within five days of the accident
- See the company doctor
Sometimes an injured worker person has the right to sue a "third party" for injuries. If you were hurt in a car accident, you may be able to collect damages from the insurance company of the driver who hit you.
Some clients pursue both Social Security disability and a workers' compensation claim. Our law office handles both SSDI and workers' comp.
